Official Rules

 Win a 2023 Jeep® Gladiator® Turbo Diesel + $30,000 CASH (BUSA23) 

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE "OFFICIAL RULES". VOID WHERE PROHIBITED.

BUSA23 PROMOTIONAL PERIOD: The “BUSA23” Giveaway (herein referred to as the “Giveaway”) begins on or about 12:00:01 a.m. Eastern Standard Time (“EST”) on January 16, 2023 ("Start Date") and ends at 11:59:59 p.m. EST on March 16, 2023 (the “Promotion Period”). The Giveaway is sponsored by Built USA, LLC. 35246 US Hwy 19 N Ste 175 Palm Harbor, FL 34684 (the “Sponsor” and “Prize Supplier”). The official clock for purposes of the Giveaway is the computer of the Sponsor. 

BUSA23 ELIGIBILITY: The Giveaway is open to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older (exceptions-must be 19 years of age or older for those that reside in the states of Alabama, Nebraska, and 21 years of age or older in state of Mississippi) as of the date of entry. Officers, members, directors, representatives and employees of the Sponsor and any of their respective parent companies, affiliated companies, subsidiaries, dealers, franchisees, licensees, distributors, suppliers, subsidiaries, participating retailers, advertising / promotion/judging agencies, persons engaged in the development, production or distribution of materials for this Giveaway (the “Giveaway Entities”), parents, grandparents, children, grandchildren, siblings, - whether biological, adopted, step or in-law) of such individuals, or persons living in the same household as such individuals (whether related or not), are not eligible to participate in the Giveaway. Participants selected as potential prize winners must have a unique, personal, and valid social security number for Sponsor (defined below) to report the tax liability associated with acceptance of the prize. Valid social security numbers will be determined by Internal Revenue Service (“IRS”) requirements as further defined in the “PRIZE CLAIMS'' section of these Official Rules. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Participant's full and unconditional agreement to these Official Rules and Sponsor decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void Puerto Rico, the U.S. Virgin Islands, Guam, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law, regulation or ordinance. 

BUSA23 HOW TO ENTER THE GIVEAWAY: An individual will be deemed a participant ("Participant") in the Giveaway if they are eligible and enter the Giveaway via any of the following three (3) entry methods: 

1) Online Merchandise Purchase:  Visit www.builtusa.com (a "Website") and complete a purchase during the Promotion Period.  For each dollar ($1.00) spent (excluding shipping & handling and tax) the Participant will receive one (1) Giveaway entry. Participants will need to provide the following information: first and last name, home address, telephone number, and e-mail address.

 2) Membership Entry: During the Promotion Period, visit BuiltUSA.com and purchase any one of our Membership options. Entries are conditional on maintaining your membership status active and in good standing in the Membership Program selected. If, during the Promotion Period you cancel your membership, you will no longer continue to receive the benefits of the Membership Program. If, during the Promotion Period Participant upgrades or downgrades their membership during the month, Participant will receive the appropriate number of entries based on the type of membership in good standing as of the 1st of the month. If a Participant initiates a credit card charge-back, the corresponding number of entries associated within the membership will be revoked. 

3) FREE Mail-in Entry: Participants can enter by hand writing on a 3”x 5” card: “BUSA23” Giveaway entry, your first and last name, address, city, state, zip, telephone number, e-mail address and date of birth. Then on the opposite side of the index card complete the sentence: "I want to be the WINNER of Built USA’s 23rd Giveaway for the 2023 Jeep® because…” please include an additional 35 words or more. Insert the card in a standard business-size envelope, with handwritten return address (including Participant’s first name and last name) and mailing address on the front of the envelope, and mail to: BUSA23 2023 Jeep® + $30,000 CASH Giveaway, 35246 US Hwy 19 N Ste 175 Palm Harbor, FL 34684. Each valid mail-in entry will receive ten (10) Giveaway entries. Each mail-in entry must include all requested information and format (as stated above and below) to be considered a valid entry. Bulk shipments (multiple entries in one shipping package) will not be accepted and will be destroyed. Limit one (1) mail-in entry per envelope. Mail-in entries must be postmarked between January 16, 2023 and March 17, 2023, and must be received by March 20, 2023. Requests for confirmation of receipt of mail-in entries will not be acknowledged. Mail-in entries must be original; no photo copies, facsimiles or reproductions of a mail-in entry will be accepted.

Throughout the Promotion Period, the Sponsor will be announcing opportunities on the Sponsor Website to earn multiples of entries (multiples of: 2 times (2X), 5 times (5X), or 10 times (10X) based on total purchase (excluding shipping & handling or and tax) or mail-in  entry. For every dollar ($1.00) spent, or individual mail-in entry, multiple entries will be earned into the Giveaway during the specified time period. During this specified time period, mail-in entries must follow the aforementioned mail-in entry submission process and must hand write the words ("2X Multiplier”, "5X Multiplier”, or "10X Multiplier”) corresponding to the Sponsor’s announced entry multiplier opportunity offer) on the bottom left hand side of the front of the envelope to receive the multiple entries.  The postmark date must correspond to the announced entry multiplier date or the mail-in entry is void. If the announced entry multiplier opportunity offer falls on a Sunday, the mail-in entry must be postmarked the Monday immediately following the offer to receive the respective entry multiplier corresponding to the Sunday offer.

 “Members ONLY” Bonus Entries: Participants that enroll in any Built USA Monthly Membership option are privy to a “Member’s ONLY” Bonus. For each dollar ($1.00) spent (excluding shipping & handling and tax) the Participant will receive twenty (20) Giveaway entries. Participants that mail-in entries must follow the aforementioned mail-in entry submission process and must hand write the words "Member’s ONLY” on the bottom left hand side of the front of the envelope if they would like to receive the bonus entries. 

All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Internet entries must be made by the Participant only at the aforementioned Website(s) and application URL addresses.  Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including, but not limited to, commercial Giveaway subscription notification and/or entering service sites, will be declared invalid and disqualified for this Giveaway. Sponsor reserves the right, in its sole discretion, to void any and all entries the Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Giveaway. Proof of entering information is not considered proof of delivery to or receipt by Sponsor of an entry. The use of automated entry devices is prohibited and no mechanically reproduced entries are allowed; all such entries are void. Released Parties are not responsible for: lost, late, incomplete, illegible, incorrect, damaged, delayed, garbled, undelivered, misdirected, or postage-due registrations, entries or mail, which will be disqualified. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

If a Participant opts to enter via their wireless mobile device (which may only be available via participating wireless carriers and is not required to enter the Giveaway), standard text messaging and/or data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Giveaway. Participation in this Giveaway by mobile device means that you understand that you may receive additional messages by mobile device relating to this Giveaway, including notifying you if you are a winner, which may be subject to charges pursuant to your carrier's rate plan. Text messaging may not be available from all mobile phone service carriers and handset models. Mobile device service may not be available in all areas. Check your phones capabilities for specific instructions.

 

BUSA23 PRIZE: One (1) Grand Prize will be available to be awarded. The Grand Prize winner (“Prize Winner '') will receive One (1) 2023 Jeep® Gladiator®, having a Manufacturer Suggested Retail Price (the “MSRP”) of approximately $98,921.  The vehicle options for the vehicles will be selected by the Sponsor in its sole discretion. In addition, to the aforementioned vehicles, the Grand Prize winner Winner will receive $30,000 (to be awarded as a check). Collectively, the 2023 Jeep Gladiator and the $30,000 check shall be referred to as the “Grand Prize''.  The Grand Prize Winner will be solely responsible for: any additional equipment, title, vehicle registration fee, dealer documentation fee,  license delivery, dealer prep, freight, emissions inspection, federal, state and local taxes, insurance, gasoline, vehicle maintenance and all other fees and expenses associated with receipt and use of the prize vehicles. Any additional vehicle options will be the responsibility of the Grand Prize Winner. Vehicles may not meet safety or emissions testing required in some states, provinces, territories and/or counties/municipalities. Winner is responsible to check their state/province for applicable emissions requirements and must use vehicle in accordance with those regulations. 

 The Grand Prize Winner must provide proof of valid insurance and a valid driver’s license** to take delivery and must take delivery from the Built USA, LLC Headquarters in Holiday Florida within fifty (50) days of being declared the Prize Winner. Grand Prize winner Winner will be provided with one (1) one-way coach plane ticket (or ground transportation if within 200 miles) to Built USA, LLC Headquarters in Holiday Florida. The value of the one-way travel is estimated to be $500 and is included in the prize value; should the Prize winner not utilize the air travel, the prize value will be reduced.   Travel is subject to capacity controls, availability, limitations, and other restrictions, all of which are subject to change at Sponsor’s sole discretion. Airfare for the Grand Prize Winner will be coordinated and determined by Sponsor (or its designee). Once travel is booked, no change, extension or substitution of trip dates is permitted, except by Sponsor at its sole discretion. The Released Parties shall have no responsibility or liability for cancellations and/or delays or any change by the air carrier(s). It is the responsibility of the Grand Prize Winner to arrive at the departure airport in time for the flights, with proper government-issued travel documentation and proper identification. Certain travel and security restrictions may apply and it is the responsibility of the Grand Prize Winner to comply with all travel, security and other laws, regulations, airline passenger and accommodation rules that apply to them. The Grand Prize Winner will be solely responsible for all other expenses while redeeming the Grand Prize (such as incremental airline charges, passport/visa, travel insurance, ground transportation in and around destination location, meals, beverages, taxes, gratuities, merchandise, souvenirs, hotel services, telephone charges, tips/gratuities, side trips and excursions,  and any other incidentals). Prize Winner must execute liability/publicity release prior to issuance of travel documents. Prize Winner is solely responsible for arranging for transport of the Grand Prize from Sponsor’s location in Holiday, FL to Grand Prize Winner’s destination of choice.. The maximum total Approximate Retail Value (“ARV”) for the Grand Prize is $129,421.

  ** If the randomly selected Prize Winner is unable to provide a valid Driver's License, the randomly selected Prize Winner must provide a state issued photo ID or Passport. If the randomly selected Prize Winner requires assistance traveling or driving, the randomly selected Prize Winner will be responsible for all expenses, including airfare, for the traveling companion. Please note, reasonable accommodations will be made for any randomly selected Prize Winner to collect their prize, as long as the above mentioned requirements are met.

BUSA23 WINNER SELECTION: The Grand Prize Winner will be selected from among all eligible entries received, in a random drawing on or about March 20, 2023, by the Giveaway administrator, whose decisions are final and not subject to challenge and/or appeal in all matters relating to this Promotion/Giveaway. Odds of winning a prize will depend on the total number of eligible entries received for the random drawing. The Prize Winner will be notified by telephone. Upon initial notification and verification of the potential Prize Winner, confirmation will be sent to the Prize Winner via email. 

 BUSA23 PRIZE NOTIFICATION/PRIZE CLAIM: Potential Grand Prize Winner will be notified by phone and must reply within (24) twenty- four (24) hours from the first notification attempt with the requested information. In the event the potential Grand Prize Winner fails to return the requested information by the date indicated, or if potential Grand Prize Winner is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential Grand Prize Winner will be disqualified and an alternate potential Grand Prize Winner will be selected from the remaining eligible entries. If the notification is returned as undeliverable, this will result in disqualification and an alternate potential Grand Prize Winner will be selected.

Except where prohibited, potential Grand Prize Winners must sign and return within the time frame specified, an Affidavit of Eligibility/Liability/Publicity Release Form, an IRS Form W-9, (collectively, the “Paperwork”) in order to claim the Grand Prize. If potential Grand Prize Winner fails to return the Paperwork by the date indicated, then that Grand Prize Winner forfeits their right to the Grand Prize (without compensation of any kind) and an alternate potential Grand Prize Winner will be selected at random from among all remaining non-winning eligible entries received, at Sponsor’s sole discretion.

The value associated with the Grand Prize may be taxable as income and the Grand Prize Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the Grand Prize. The Sponsor must report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that potential Prize Winner does not have a unique, personal and valid social security number or tax identification number for Sponsor to report the tax liability associated with acceptance of the Prize, he/she will be disqualified and an alternate potential Grand Prize Winner will be selected at random from among all remaining non-winning eligible entries received, at Sponsor’s sole discretion, time permitting. Valid social security numbers or tax identification numbers will be determined by IRS requirements.

BUSA23 USE OF PERSONAL INFORMATION: By entering the Giveaway, Participant consents for the Sponsor to obtain, use, and transfer your name, address and other information provided for the purpose of administering this Giveaway; the information provided in connection with the entry process will be used by Sponsor and Administrator only, in accordance and will not be sold or provided to another company.  Participant entry information will be treated according to Sponsor’s privacy policy (https://builtusa.com/pages/privacy-policy). By participating in the Promotion and providing any contact information, Participants hereby agrees to Sponsor’s collection and usage ofParticipant’s personal information and acknowledges that they have read and accepted Sponsor’s Privacy Policy.

BUSA23 INTERNET LIMITATIONS OF LIABILITY: If for any reason this Giveaway is not capable of running as planned for any reason, including, without limitation, due to infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm, or other natural cataclysm, pandemic, health crisis, riot, strike, civil commotion, government regulation, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Giveaway, in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Any person who supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and Sponsor reserves the right to seek all legal remedies permitted by law may be prosecuted to the full extent of the law.  Released Parties assume no responsibility for any incomplete, incorrect, or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Participant's or any other person's computer (or any information/material stored therein) relating to or resulting from participation in this Giveaway or downloading any materials in this Giveaway. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted e-mail address.   

 BUSA23 PRIZE TERMS AND CONDITIONS: Prize Winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. The Grand Prize Winner will be required to complete and sign an Affidavit of Eligibility/Liability/Publicity Release Form, an IRS Form 1099, and provide proof of identity (collectively, the “Paperwork”), and must reply within (24) twenty four hours from the first notification attempt with the requested information or the prize may be forfeited and an alternate potential winner selected, time-permitting. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue. To claim a prize, all Prize Winners will be required to provide their correct full-name, mailing address, date of birth, telephone number and/or e-mail address, and proof of identification. The Prize Acceptance ReleasePaperwork and proof of identification is subject to verification by Sponsor and all potential Prize Winners are subject to verification before any prize will be awarded. 

 

The Sponsor and Released Parties have not made any warranty, representation or guarantee, expressed or implied, in fact or in law, with respect to any prize awarded and specifically disclaim all such warranties, including, without limitation, any warranty of merchantability or fitness for a particular purpose. The prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND either expressed or implied. A The right to obtain a prize may not be sold, traded, or commissioned, and is not exchangeable or transferable, except in Sponsor's sole discretion. Prize details and availability are subject to change. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize (or prize component) with another prize (or prize component) of equal or greater value. The Administrator is not the prize supplier. Prize may be fulfilled by a third party. The Sponsor and Released Parties are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Giveaway. All properly claimed prizes will be awarded.

Prize Winner’s acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the Prize Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation. The Prize Winner understands and agrees that the Prize ceremony may be videotaped/ photographed. Rights to any Prize ceremony video/photo belong solely to the Sponsor and can be used in any media at their sole discretion.

  All Prize Winners consent to provide a follow up video between 30-45 days after claiming their Grand Prize. Stipulations included in the Prize Winner Information Packet apply.

BUSA23 MODIFICATION: In no event will Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules. No Grand Prize substitution or cash alternative offered, except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if Grand Prize becomes unavailable due to reasons beyond the control of the Sponsor; provided no such substitute prize shall be from Sponsor without its prior written consent. Prizes are not transferable. Any taxes imposed on the income of the Prize Winner as a result of winning the Grand Prize and all other expenses not specifically mentioned herein as part of the Grand Prize are solely the responsibility of the Prize Winner. No more than the number of prizes set forth in these Official Rules will be awarded. Sponsor does not make, nor is Sponsor in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including but not limited to its quality, fitness for purpose or mechanical condition; the only representation/warranty/guarantee that may be provided relative to the Grand Prize, if any, are those of the manufacturer and/or dealer.  If for any reason Sponsor determines, in its sole discretion, that the Giveaway is no longer capable of running as intended by these Official Rules for any reason whatsoever, Sponsor reserves the right to terminate, suspend, postpone, delay or modify the Giveaway, in whole or in part, including, but not limited to, any occurrences described in sections above, or any other causes which may corrupt or impair the integrity, security, fairness or proper conduct of the Giveaway.  If Sponsor determines that more prize claims are submitted or more prize notices are distributed than the number of prizes offered in these Official Rules, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. For example, Sponsor may select a winner in a random drawing from among the eligible entries received up to the time of the impairment or conducted a random drawing among all prize claimants, and neither Sponsor nor any of the Released Parties shall have any further liability to any Participant in connection with the Giveaway.

BUSA23 RELEASES: All Participants, as a condition of participation in this Giveaway, agree to indemnify, release and hold harmless Sponsor and Released Parties from and against any and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Sponsor's Website; (b) participating in any aspect of the Giveaway, including, without limitation, while preparing for, participating in and/or traveling to or from any prize or Giveaway -related activity, including, without limitation, any injury, damage, death, loss or accident to person or property; (c) the receipt, ownership, possession, use or misuse of any prize awarded; (d) viruses or any downloading or other problems with the Giveaway application, or; (e) any typographical or other error in these Official Rules or the announcement of offering of any prize. By participating in the Giveaway, Participant agrees to release, discharge, indemnify and hold harmless the Giveaways Entities, Twitter, Inc., Facebook, Inc., Instagram, Inc., TikTok, Inc., or Google, Inc. and each of their respective directors, officers, employees, agents, successors and assigns (the “Released Parties”) from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines or injuries (up to and including bodily injury and death) of any kind arising out of or related to: (i) Participant’s participation in the Giveaway; (ii) any acceptance, possession, misuse or use of any prize (including, without limitation, losses, damages or injuries to Participant’s or any other person’s equipment or other property, or to their persons, including those arising from any travel to/from any prize event or activity); (iii) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (iv) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Giveaways activity and/or prize Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize, except for any express manufacturer's warranty as may be included with the prize. Prize Winner bears all liability and risk of loss or damage to their respective prize after it has been delivered. 

 SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS. Entry information becomes property of Sponsor. All federal, state and local regulations apply.

BUSA23 GOVERNING LAW/DISPUTES: The parties agree that the Giveaway and these Official Rules and any additional supplemental rules will be governed, construed and interpreted under the laws of the State of Florida, without giving effect to any choice of law or conflict of laws rules (whether of the State of Florida or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of Florida.

BUSA23 DISPUTE RESOLUTION: Entrants, Sponsor, Sweepstakes Giveaway Entities, and the Released Parties (each, a “Party” and collectively the “Parties”) each agree to fully and finally settle all disputes only through binding arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts for Pinellas County, Florida and any other court with jurisdiction over the Parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award are final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The Parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes Giveaway shall be resolved solely by binding arbitration conducted in English before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either Party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Palm Harbor, Florida. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction for Pinellas County, Florida.

Scope. T, this agreement to arbitrate claims and disputes is intended to be broad and includes, without limitation, (i) claims or disputes relating to any aspect of the Giveaway, whether based in contract, tort, statute or any other legal theory, (ii) claims or disputes directly or indirectly arising from conduct or events that occurred prior to the effective date of these Official Rules or any additional supplemental rules (including, without limitation, claims relating to advertising), or after its termination, (iii) claims or disputes subject to class action litigation in which you are not currently a member of a certified class, and (iv) claims or disputes with any agent, employee, successor or assign of you, the Sponsor, or the Sweepstakes Giveaway Entities (all such claims and disputes are referred to collectively as “Claims”). This agreement to arbitrate does not, however, include Sponsor’s Claims pertaining to intellectual property rights.

No Preclusive Effect. No award or finding or stipulation of fact by the arbitrator will have any preclusive or collateral estoppel effect in any other arbitration or court, unless it involves the exact same parties.

 Severability., If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable or illegal provision were not contained herein.

Notwithstanding the foregoing, Sponsor may seek equitable relief in any court of competent jurisdiction.

BUSA23 WINNERS LIST REQUEST: Grand Prize Winner will be announced on the Sponsor’s website and/or social media pages after Grand Prize Winner has been verified and the Grand Prize claimed. The winners’ list will be available after winner validation has been completed at https://builtusa.com/pages/our-previous-winners.

The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance ReleasePaperwork will not affect the validity or enforceability of any other provision.  In the event that any provision of the Official Rules or the Prize Acceptance ReleasePaperwork is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Participants, to the extent there is a conflict between Official Rules appearing at any other location and any terms of use or other agreements posted on the Sponsor's Website, these are the Official Rules to be abided by.   

Chrysler®, Dodge®, Jeep®, Ram®, FCA Group® or FCA US, LLC®. and respective affiliates, subsidiaries, shareholders, representatives, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with the participation in this Giveaway or any prize awarded, and has not offered or sponsored this Giveaway in any way.
